Terms & Conditions
In these terms and conditions, Pharmdx Sdn Bhd (referred to as “Pharmdx” or “we” or “us” or “our”) and the “Customer” (referred to as “Customer” or “you” or “your”) will mean any person, firm, company, or body which places an order with us. By using this website or any part of it, you agree that you have read these terms and conditions and that you understand, accept, and agree to be bound by them, as well as by our Privacy Policy, Delivery & Pick-Up Policy, and Return & Refund Policy, which form an integral part of these Terms.
1.0 General
1.1 We reserve the right to amend these terms and conditions at any time, at our sole discretion, by posting such amendment(s) to our website without prior and separate notice.
1.2 Your continued use of our website or any part of it after an amendment has been posted shall constitute full knowledge and acceptance of the revised terms. If you do not agree, kindly notify us in writing at support@pharmdx.com.my.
2.0 Price and Product
2.1 All product prices listed are in Ringgit Malaysia (RM) and may include applicable local taxes and charges. Delivery costs will be charged in addition, where applicable.
2.2 Prices are subject to change without prior notice and all orders are subject to Pharmdx’s acceptance at its sole discretion and stock availability. The applicable price is the one valid on the day you place an order.
2.3 Orders are subject to confirmation of availability. We reserve the right to reject any order if products are unavailable.
2.4 All product images and media on our website are for illustration only. Actual product size, dimension, and color may vary.
2.5 Free gifts may be substituted with items of equal value subject to availability. They are non-refundable, non-exchangeable, and provided on a first-come, first-served basis.
3.0 Registration and Account
3.1 Customers registering an account must provide accurate, complete, and up-to-date information.
3.2 You must safeguard your username, password, and login information at all times.
3.3 Pharmdx reserves the right to refuse or terminate your account at its discretion.
3.4 You should update your account information promptly to enable effective communication.
3.5 You are liable for every order made under your account and agree to indemnify Pharmdx against all claims, losses, or damages arising from such actions.
3.6 You must notify Pharmdx immediately of any unauthorized use or suspected breach of security by emailing support@pharmdx.com.my.
4.0 Online Orders
4.1 Orders must be paid in full at checkout via the payment gateway before processing.
4.2 An order confirmation email will be sent once your order is accepted.
5.0 Order Cancellation
5.1 Order cancellation requests must be made in writing via support@pharmdx.com.my.
5.2 Orders cannot be cancelled once shipped. Please refer to our Return & Refund Policy.
6.0 Payment Terms
6.1 We accept payment by credit card, online banking, and e-wallets only. Cash on delivery is not available.
6.2 Full payment must be made upon order placement. If your payment cannot be processed, your order will not be accepted.
7.0 Subscription Programme Terms
7.1 Eligibility
7.1.1 The Subscription Programme applies only to selected products (“Subscription Eligible SKUs”) as listed on our website.
7.1.2 The Programme is open to all registered customers with a valid payment method.
7.2 Subscription Period
7.2.1 Customers may select the preferred preferred products at a three (3)-months subscription period.
7.3 Discounts & Benefits
7.3.1 Subscription discounts, promotional offers, or free gifts (if any) apply only to active, uninterrupted subscriptions.
7.4 Commitment
7.4.1 Customers must complete at least three (3)-months subscription cycles unless otherwise stated on the product page.
7.4.2 If a subscription is cancelled before the is completed, Pharmdx may recover the discount granted by charging the difference between the subscription price and the regular retail price of products already delivered.
7.5 Billing & Payment
7.5.1 Payment will be charged automatically to the customer’s chosen payment method prior to each scheduled shipment.
7.5.2 If payment is unsuccessful, Pharmdx may suspend or cancel the subscription order.
7.6 Shipping & Delivery
7.6.1 Subscription orders will be processed and delivered based on the chosen subscription frequency.
7.6.2 Pharmdx shall not be liable for delays due to stock availability, public holidays, or courier service issues.
7.7 Cancellations
7.7.1 Customers may cancel a subscription at any time via their account or by notifying Pharmdx in writing at support@pharmdx.com.my.
7.7.2 Cancellations will take effect before the next billing cycle, provided the cancellation is made at least seven (7) days prior to the next scheduled billing date.
7.8 Modifications & Termination
7.8.1 Pharmdx reserves the right to modify product eligibility, pricing, or discontinue the Subscription Programme by providing at least seven (7) days’ notice to customers.
7.8.2 Customers will be notified via email or through their account.
7.9 Returns & Refunds
7.9.1 Subscription orders are subject to the same Return & Refund Policy as regular purchases.
8.0 E-Dispensary Partnership Programme
8.1 Scope
8.1.1 Pharmdx operates an E-Dispensary Partnership Programme (“Programme”) for healthcare professionals (“Partners”) who are registered and accepted into the Programme.
8.1.2 The Programme allows Partners to provide professional product recommendations via referral mechanisms made available on our platform.
8.2 Partner Responsibilities
- Recommend only Company-approved products via referral codes or links.
- Prohibited from stockholding for retail resale or distributing products via other channels.
- Ensure recommendations are based on professional judgment in line with clinical standards.
- Not make unverified claims and represent products only as described in official Pharmdx materials.
- Comply with professional codes of conduct and applicable governing body regulations, i.e. Malaysian Medical Council, Pharmacy Board and other relevant governing bodies.
- Not associate Pharmdx with prohibited content (illegal activities, gambling, tobacco, weapons, alcohol, pornographic or explicit content, hateful speech, malicious software, or sensitive Race, Religion, and Royalty (3R) content).
8.3 Fees and Incentives
8.3.1 Partners are entitled to professional fees as determined by Pharmdx.
8.3.2 The applicable fee structure will be displayed in the Partner’s account dashboard or system, and shall apply at the time of transaction.
8.3.3 Pharmdx reserves the right to amend the fee or incentive structure with prior notice via email, dashboard notification, or other official communication channels.
8.3.4 Continued participation in the Programme after such notice constitutes acceptance of the revised structure.
8.4 Term and Termination
- Participation is ongoing unless terminated by either party.
- Pharmdx reserves the right to suspend or terminate participation immediately for misconduct, breach of terms, or non-compliance with applicable laws or Company policies.
8.5 Relationship
- Partners are independent professionals under the Programme.
- The term “Partner” does not imply equity, employment, or legal partnership rights.
8.6 Conflict of Interest
- Partners must not be employed by retail pharmacies involved in B2B sales of products offered by Pharmdx or its affiliates, unless disclosed and approved.
- Failure to disclose may result in immediate suspension or termination.
8.7 Confidentiality
- Partners must maintain confidentiality of all proprietary or sensitive information, including Programme details, customer data, pricing, and business operations.
- This obligation survives Programme termination.
8.8 Compliance with Laws
- Partners must comply with Malaysian laws, healthcare advertising regulations, and ethical marketing practices.
- Off-label promotion or unauthorized medical claims are strictly prohibited.
8.9 Intellectual Property
- Pharmdx grants Partners a limited, non-transferable license to use official product images, names, and materials for Programme purposes.
- All intellectual property rights remain with Pharmdx or its licensors.
9.0 Limitation of Liability & Disclaimer
9.1 To the fullest extent permitted by law, Pharmdx shall not be liable for any indirect, incidental, special, or consequential losses or damages, including but not limited to loss of profits, business, goodwill, or data.
9.2 All products sold are intended for their described purposes only. Pharmdx makes no warranties, express or implied, regarding suitability for any unintended or off-label use.
9.3 Product information on our website is for general information purposes only and should not be taken as medical advice. Customers are advised to consult a qualified healthcare professional before use.
10.0 Intellectual Property
10.1 All content on this website, including but not limited to text, images, graphics, logos, trademarks, software, and design, are owned or licensed by Pharmdx.
10.2 Customers and Partners may not copy, reproduce, modify, distribute, or use any part of the website content for commercial purposes without prior written consent from Pharmdx.
10.3 Any unauthorized use of the website content may result in legal action.
11.0 Governing Law & Dispute Resolution
11.1 These terms and conditions are governed by and construed in accordance with the laws of Malaysia.
11.2 Any disputes arising shall fall under the exclusive jurisdiction of the courts of Malaysia.
11.3 Pharmdx may, at its discretion, require parties to attempt to resolve disputes through mediation or arbitration before pursuing court proceedings.
